Terms of Use

Effective October 5, 2026

The short version

Green Mind helps you plan a Gulf Coast garden. It gives you gardening information, advice, and data — not a guarantee of success. Gardening depends on weather, soil, and care we cannot see or control, and we do not control the weather. Our plant diagnosis, garden assistant, and bed plans are automated suggestions that can be wrong. Sections 8 through 13 and section 21 are the ones that matter if something goes wrong.

1. Acceptance

Green Mind: Zone 9 (“GreenMind”) is operated by ConcordiaPax LLC (“Cpax”, “we”, “us”). By using GreenMind — other than to read these Terms — you agree to them and to our Privacy Policy (section 19). Your right to use GreenMind is personal to you and is not transferable. You are responsible for all use of your account and for keeping your password confidential.
We may change or discontinue any part of GreenMind, including its features, content, availability, and the equipment needed to use it.

2. Changes to these terms

We may change these Terms. When a change materially affects your rights or obligations, we will update the effective date above and notify account holders by email before the change takes effect. Other changes take effect when posted. If you create an account after a revised version is posted, that version applies to you from the start.
Continuing to use GreenMind after a change takes effect means you accept it. If you do not, stop using the service and delete your account.

3. What GreenMind is

GreenMind is a gardening assistant for USDA Zone 9 households, serving Galveston County, Texas first. It provides:
—
a planting calendar and seasonal plan built around your ZIP code, garden goal, and available space;
—
a bed planner that lays out the crops you choose using typical plant spacing;
—
a garden assistant that answers questions about your plan, produced by an automated model;
—
weather-aware task suggestions and alerts;
—
plant-problem diagnosis from photographs you submit, produced by an automated model;
—
gardening articles and curated guidance, which is organic and environmentally responsible by policy, with links to outside resources;
—
optional referral to local service providers for work you request.
GreenMind is an information and planning tool. It is not a horticultural, agricultural, pest-control, weather, emergency, medical, or veterinary advisory service, and using it does not create a professional relationship.

4. Your account

You must be at least 18 to create an account. GreenMind is not directed to children under 13 and we do not knowingly collect their information.
You are responsible for the accuracy of what you tell us. A planting plan built on the wrong ZIP code or the wrong bed size will be wrong, and that is not a defect in the service.

5. Equipment

You are responsible for the hardware, software, connectivity, and any charges needed to reach GreenMind.

6. How you may use it

You agree not to:
—
use GreenMind unlawfully, or in violation of any pesticide, herbicide, water-use, burn, or environmental regulation that applies to you;
—
upload photographs of property you do not own or occupy, or of other people, without permission;
—
upload anything unlawful, infringing, malicious, or deliberately misleading;
—
scrape, bulk-download, or systematically extract our guidance, calendar data, crop data, articles, images, or other content, whether by hand or with automated tools;
—
use GreenMind or its content to build, train, or improve a competing product or model;
—
resell or redistribute the guidance as your own service;
—
harass, threaten, or abuse other users or our team, in any feature where you can reach them;
—
access another user’s account or data, probe the security of the service, get around usage limits, or interfere with its operation.
See section 23 for what we may do about conduct that violates this section.

7. Beta access and future subscriptions

GreenMind is launching as a free beta. We are not currently offering or collecting payment for a GreenMind subscription. Settings labels the planned subscription as “Coming Soon” and provides no Checkout or payment action during beta.
We may grant complimentary extended access to selected beta testers and eligible Substack subscribers. Substack subscriptions are purchased from and managed through Substack under its terms; GreenMind does not process that payment. A complimentary GreenMind grant may expire or be revoked, and it does not create an auto-renewing GreenMind purchase.
Before paid GreenMind subscriptions launch, we will show the price, renewal period, cancellation method, refund terms, and applicable tax disclosures before purchase.

8. Gardening guidance is not a guarantee

GreenMind provides gardening information, advice, and data. It does not guarantee success. We cannot promise that following it will produce any particular yield, harvest, germination, or plant survival. Crop failure and plant loss are ordinary risks of gardening and remain yours.
Gardening outcomes depend on weather, soil, water, seed and plant stock, timing, pests, disease, and the care actually given — nearly all of which are outside our knowledge and entirely outside our control.
Our calendars, task suggestions, planting windows, bed plans, articles, and recommendations are general guidance based on regional patterns and published sources. They are not predictions and not professional advice. You decide what to plant, when, and how, and you are responsible for checking anything that matters to you against your own judgment, the seed packet or plant tag, and local conditions.
Gardening is physical work, often in heat, sun, and among insects, thorns, and tools. You are responsible for your own safety and the safety of anyone helping you.

9. We do not control the weather

We do not control the weather, and we cannot protect your garden from it. Weather preparation tips are suggestions, not a guarantee that plants, crops, or property will survive.
Forecasts, freeze and heat warnings, rain totals, and storm information come from third-party providers. They can be late, wrong, incomplete, or not delivered at all. GreenMind may suggest ways to prepare for weather events — covering plants, harvesting early, adjusting watering, or securing beds and containers — but acting on those suggestions does not guarantee any outcome.
Do not rely on GreenMind for your personal safety or for protecting your home during severe weather, including hurricanes, tropical storms, flooding, and freezes. Follow the National Weather Service and your local emergency officials.

10. Plant diagnosis is automated and can be wrong

Never eat, apply, or administer anything on the basis of a GreenMind diagnosis alone.
Diagnosis from photographs is produced by an automated model. It is a suggestion, not an identification, and it can be confidently wrong — particularly with unusual conditions, poor photographs, plants from outside our region, or problems with more than one cause.
Do not rely on GreenMind to decide whether a plant is safe to eat, whether a plant or mushroom is toxic, or whether a substance is safe for people, pets, or livestock. For anything that could affect health or safety, consult a qualified professional — a county extension office, a licensed arborist or applicator, a physician, or a veterinarian.

11. Garden assistant answers and bed plans are suggestions

The garden assistant’s answers are produced by an automated model. They can be incomplete, out of date, or wrong, even when they sound confident. Treat them the way you would treat advice from a well-read friend, not an expert who has seen your garden. The warnings in sections 8, 9, 10, and 12 apply to its answers too.
The assistant has a daily question limit, and we may change it. Do not type personal, financial, or health information into it; it does not need any to answer gardening questions.
Bed plans are laid out from typical spacing for each crop. Where we have no published spacing for a crop — including crops you name yourself — the planner uses a general default and marks it as estimated. Plans are a starting point. Check the spacing on your seed packet or plant tag before you plant.

12. Products and what you apply

Our guidance policy is organic and environmentally responsible first. We do not recommend restricted-use products or anything requiring an applicator’s license.
You are solely responsible for anything you apply to soil, plants, or property. The product’s own label is the legally controlling instruction and supersedes anything GreenMind says.
Comply with all applicable regulations, including restrictions on application near water, during wind, or before rain, and keep people, pets, and livestock clear as the label requires. We are not liable for damage to plants, soil, property, health, or the environment resulting from products you choose to apply.

13. Accuracy of information

We work to keep GreenMind accurate, but we do not promise that it is. Information on GreenMind is provided “as is” and “as available”.
Weather patterns shift. Frost dates are averages, not promises. ZIP code boundaries, USDA hardiness zone maps, and published planting recommendations are revised from time to time, and a ZIP code can span more than one set of conditions. Crop data, articles, and calendars may lag behind those changes or contain errors. We may correct, update, or remove information at any time without notice.

14. Links to other websites

GreenMind links to outside resources we find useful — for example, the Texas A&M AgriLife Extension Service, the National Weather Service, and seed and plant suppliers. We do not own or control those sites. We are not responsible for their content, accuracy, availability, products, or privacy practices, and a link is not an endorsement. Your use of another site is governed by that site’s own terms.

15. Local service providers

GreenMind may connect you with independent local service providers for work you request. Those providers are not employees, agents, or partners of ConcordiaPax LLC. We do not perform the work, supervise it, or warrant it.
Any agreement for services is between you and the provider. Verify their licensing, insurance, and suitability yourself. We are not liable for their acts, omissions, work quality, pricing, or conduct.

16. Your content, and the permission you give us

“Your Content” means the photographs, journal entries, notes, garden and bed details, questions you ask the garden assistant, service-request text, and anything else you submit. You keep ownership of it.
You grant ConcordiaPax LLC a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, process, and display Your Content in order to:
—
operate GreenMind and show Your Content back to you;
—
if we add a feature that lets you share content with other gardeners, display what you choose to share to them, for as long as you keep it shared;
—
maintain operational records and aggregate service statistics that do not identify you.
We will not publish your photographs or other content publicly without your permission. Launch training uses only reviewed, repository-authored knowledge. Private journals, scan photos and diagnoses, service requests and contact data, and engagement events are excluded and never used for model training. Historical consent flags do not grant permission to publish or train. We do not sell Your Content or license it as a dataset.
When you add a crop by name that we do not yet cover, we record the crop name — without your name or account — so we can decide which crop guides to write next.
You confirm you have the right to grant this licence for everything you submit. If you send us suggestions or feedback, we may use them without owing you anything.

17. Our intellectual property

GreenMind and everything we provide in it belong to ConcordiaPax LLC or its licensors and are protected by copyright, trademark, and other laws. That includes:
—
the Green Mind and GreenMind names, logos, and brand;
—
our images, crop icons, illustrations, photographs, graphics, and page designs;
—
our articles, Encyclopedia entries, crop cards, planting calendars, and curated guidance;
—
our crop and spacing data as we have compiled and organized it;
—
our tools — including the bed planner, garden assistant, plant diagnosis, and task engine — and the software behind them.
You get a personal, non-transferable, revocable licence to use GreenMind for your own gardening. You may not copy, republish, sell, frame, or create derivative works from it, remove copyright or trademark notices, or reverse-engineer its software, except as the law expressly allows. Facts and published sources we cite remain the property of their owners. Nothing in these Terms transfers ownership to you.

18. Third-party services

GreenMind relies on third-party hosting, database, email, weather-data, billing, monitoring, and AI providers. Cloudflare Workers AI answers garden assistant questions using a licensed Meta Llama text model, and may process diagnosis photos and prompts using a licensed Meta vision model when that production mode is enabled. Their availability and accuracy are outside our control. Weather data is a forecast, not a fact.

19. Privacy

To run GreenMind we collect personal information, including your name, email address, and ZIP code. Our Privacy Policy, at zone9.concordiapax.net/privacy, explains what we collect, how we use, secure, and store it, how long we keep it, and how to export or delete it. It is part of these Terms.

20. No warranties

GreenMind is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law. We do not warrant that GreenMind will be uninterrupted, timely, secure, or error-free, that alerts or reminders will arrive, or that its guidance, diagnoses, assistant answers, plans, or data will be accurate or complete.

21. Limit of our liability

To the fullest extent permitted by law, ConcordiaPax LLC and its members, officers, and contractors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to GreenMind — whether in contract, tort, negligence, strict liability, or otherwise, and even if we were advised of the possibility.
To the same extent, we are not liable for:
—
lost, damaged, or failed crops, plants, seeds, or harvests, or lost yields;
—
damage caused by weather, including freezes, heat, drought, flooding, and storms, whether or not GreenMind warned you or suggested how to prepare;
—
alerts, reminders, or emails that are late, wrong, or never arrive;
—
anything you eat, apply, or do based on GreenMind’s guidance, diagnosis, or assistant answers;
—
injury, illness, or property damage from gardening work, products you use, or providers you hire;
—
the content of websites and services we link to;
—
lost profits, lost data, or business interruption.
Our total aggregate liability for all claims relating to GreenMind will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred U.S. dollars ($100). These limits apply even if a remedy fails of its essential purpose.
Some jurisdictions do not allow certain exclusions or limits. Where that is so, they apply to the fullest extent permitted, and nothing here limits liability that cannot lawfully be limited.

22. Indemnification

You agree to indemnify and hold harmless ConcordiaPax LLC from claims, damages, losses, and reasonable legal fees arising out of your use of GreenMind, Your Content, your violation of these Terms, or your violation of any law or the rights of a third party.

23. Suspension and termination

You may stop using GreenMind at any time and delete your account from your account settings.
We may suspend, limit, or close your account or access to any part of GreenMind at our sole discretion, with or without notice, including if you:
—
violate these Terms or the law;
—
harass, threaten, or abuse other users or our team;
—
scrape or try to extract our data or content, including to build a competing product;
—
abuse usage limits or put the service or other users at risk.
We may also end access if we discontinue GreenMind. When we close an account for a reason other than a violation, we will try to give you notice and a chance to export your data. Sections 8 through 22 and 24, and any other provision that by its nature should survive, survive termination.

24. Governing law and where disputes are heard

These Terms and any dispute relating to GreenMind are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Any legal proceeding relating to GreenMind or these Terms must be brought only in the state or federal courts located in Galveston County, Texas, and you and ConcordiaPax LLC consent to the personal jurisdiction and venue of those courts and waive any objection that they are an inconvenient forum. Either of us may instead bring an eligible claim in a justice court in Galveston County.

25. General

If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Policy, are the entire agreement between you and ConcordiaPax LLC regarding GreenMind. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
